WHAT INFORMATION DO WE COLLECT?
When we provide services, we collect personal information, including information regarding personal injury settlements, that claimants, attorneys and other parties working on these settlements provide to us.
To provide our services, we disclose personal information in very limited instances, which include:
• We share information with individuals whom you authorize to receive it, such as your attorney, accountant or family members. • We may be required by law to disclose your information to state trust examiners who regulate our business. • We may also disclose your information to an affiliate of Midwest Trust Company which has been contracted to provide operational or investment management services, and to unaffiliated third parties which we may hire from time-to-time to review our business and regulatory practices. • We allow access to personal information to third parties who provide business services to us, including accounting, data management and other IT services. We have written confidentiality agreements with these service providers and assess their security practices periodically as part of our SOC 1 compliance program.
In addition, when permitted by law and our contractual obligations, we may use anonymized data (i.e., data with personally identifiable information removed or modified) for business analysis purposes.
Except for these few instances, we do not share personal information with third parties. We will not sell personal information.
We will keep personal information for as long as it is necessary to provide services on our clients’ accounts, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements).
We have implemented technical and organizational security measures designed to protect the security of personal information we process. However, despite our safeguards and efforts to secure personal information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise that unauthorized third parties will not be able to defeat our security. Although we will do our best to protect personal information, transmission of personal information to and from our website or via unsecured email is at your own risk. You should only access the website within a secure environment.
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. As stated above, we will not sell personal information.
